Not every dispute needs to be resolved through a court process. Every day, the courts are inundated with a long list of cases. They have to deal with criminal as well as civil matters. There is no end to the number of issues that get thrown at the courts for resolution. Every dispute that enters the court system must follow the rules of process and procedure of the courts. This means that parties have no control over how quickly their disputes will be resolved. There are, however, other legally recognized ways to resolve certain civil disputes between two private parties. These non-court processes are known as alternative dispute resolution processes, which include mediation. Mediation allows disputing parties to settle their issues outside of the court system, giving them more control over the cost, duration, and outcome of the dispute. If this is the way you are looking to resolve your legal issue such as divorce, the Millburn mediation lawyers at Nitti & Nitti are here to help.

What is Mediation?

Mediation is a dispute resolution process where a mediator assists disputing parties, through negotiation, to resolve their issues. Unlike a court resolution, there are no “winners” or “losers” in mediation. The objective is to reach a negotiated “win-win” position that serves the interests of both parties.

As with any negotiating process, an unbalanced power dynamic between the parties can affect the outcome of the process. For example, an older person with more worldly experience would have the upper hand in a negotiation with a naive, younger person. Or, in a divorce, the scales might tip in favor of the wealthier spouse who can manipulate and withhold information from the process. The mediator’s job is not to advocate for either party, but to create an environment that allows free and open communication between the parties.

Although mediation is not a court process, negotiation requires knowledge and information. Knowledge of your legal rights and information on which to make a decision. As long as these two elements are present, even complex legal issues can be mediated.

Do I Need A Mediation Attorney?

The law does not require the use of an attorney either as a mediator or representative of disputing parties. When the issues in dispute involve legal matters, you’ll get the best outcome when you have a Millburn mediation attorney who knows the law and can help you make better decisions. A mediation lawyer can investigate and reveal crucial evidence to protect your interests in the mediation process.
